Terms of Service & SMS Terms

SAM is the customer-facing service operated by Swift Asset Movement, and SamDelivers.com is its customer website. These terms govern use of the SAM platform and related services. By submitting a request, applying as a driver, or otherwise using SAM, you agree to these terms and our Privacy Policy.
Eligibility and platform role
You must be at least 18 and legally able to enter a contract. SAM coordinates on-demand movement of goods and assets between customers and approved drivers. Availability, timing, vehicle matching, and completion are not guaranteed.
Customer responsibilities
- Provide accurate addresses, contacts, dimensions, weight, contents, access conditions, photos, and special-handling information.
- Ensure the item is lawfully owned or controlled, safely packaged, ready, and paid for when required.
- Ensure a responsible contact can release and receive the item and provide any required delivery PIN only after the item arrives.
- Do not request transport of illegal drugs, firearms, hazardous materials, animals, cash, stolen goods, medical waste, or loose, undisclosed, unsafe, or prohibited loads.
Estimates, authorization, and final charges
Prices are based on the information supplied, including route, vehicle, load, labor, access, and timing. SAM may authorize the estimated amount before matching a driver. Additional mileage, waiting, labor, access conditions, or a materially different load may require a revised amount for approval. The final authorized amount may be captured after delivery, and unused authorizations may be voided according to the payment provider's processing timelines.
Cancellations, delays, and delivery proof
Applicable cancellation fees are shown before confirmation or in the tracking experience. Traffic, weather, store delays, safety conditions, inaccurate information, and events beyond reasonable control may affect timing. Pickup verification, recipient PIN confirmation, photos, timestamps, and other records may be used as proof of service.
Drivers
Drivers choose whether to accept an available offer and must comply with applicable licensing, insurance, vehicle, safety, and legal requirements. Driver approval does not guarantee offers or earnings. Drivers must stop and contact dispatch if a load is unsafe, prohibited, materially different, or requires unapproved labor or equipment.
SMS terms
SMS participation is optional and requires a separate unchecked consent selection. If you opt in, Swift Asset Movement may send transactional texts about delivery requests, driver offers or matching, arrival, pickup, delivery, security codes, changes, and support at the mobile number you provide.
- Message frequency varies with your activity.
- Message and data rates may apply.
- Reply STOP to opt out. Reply HELP for help.
- Consent to texts is not a condition of purchasing or using SAM services.
- Carriers are not liable for delayed or undelivered messages.
After opting out, you may receive one final confirmation message. Essential service information may still be provided through the website, email, or other available channels.
Acceptable use and safety
You may not misuse the platform, interfere with operations, evade fees, submit false information, harass another person, compromise security, or use SAM for unlawful activity. SAM may pause or refuse a request, driver, account, item, route, or transaction when reasonably necessary for safety, fraud prevention, compliance, or platform protection.
Third-party services
The platform may rely on payment, mapping, messaging, identity, storage, and other service providers. Their services may be governed by additional terms and may occasionally be unavailable.
Disclaimers and limitation of liability
To the fullest extent permitted by law, the platform is provided on an “as available” basis without warranties not expressly stated here. SAM is not liable for indirect, incidental, special, exemplary, or consequential damages. Any limitation that cannot lawfully apply will apply only to the maximum extent permitted.
Governing law and changes
These terms are governed by Georgia law, without regard to conflict-of-law rules. We may update them as the platform develops; the current version and date will remain posted here. Continued use after an update constitutes acceptance of the revised terms to the extent permitted by law.
